The Fine Wine Gang has adopted this Privacy Policy, the purpose of which is to inform Users in a transparent manner about the website hosted at the following address: finewinegang.be (hereinafter the "Site"), and about the way in which personal data is collected and processed by The Fine Wine Gang.
The term "User" refers to any user, whether a natural or legal person, who visits the Site or communicates with the Site in any way.
In its capacity as data controller, The Fine Wine Gang determines all technical, legal and organisational means and the purposes for the processing of Users' personal data. The Fine Wine Gang undertakes to take all necessary measures to ensure that the processing of personal data takes place in accordance with the Act of 30 July 2018 and Regulation (EU) 2016/679 (GDPR).
The Fine Wine Gang is free to choose a natural or legal person to process the personal data of users on its behalf and at its request (hereinafter the "Processor" or "Subcontractor").
2. Processing of personal data
Use of the Site by Users may lead to the collection of personal data. The processing of such data by The Fine Wine Gang is carried out in accordance with the Act and the Regulation.
Personal data are processed by The Fine Wine Gang through the following methods:
- Newsletter sign-up form
- Automated procedure for attending a tasting or masterclass
- Use of cookies
- Provision of free content
- Order fulfilment
3. Purpose of the processing of personal data
In accordance with Article 13 of the Regulation, the purposes of the processing of personal data are communicated to the User. These purposes are as follows:
- The performance of the services offered and agreed on the webshop.
- Legal obligation to keep records.
4. Personal data that may be processed
The User agrees that, during their visit to and use of the Site, The Fine Wine Gang collects and processes the following personal data: surname, first name, e-mail address, telephone or mobile number, date of birth.
5. Consent
By accessing and using the Site, the User declares that they have read and given their free, specific, informed and unambiguous consent to the processing of their personal data.
Consent is given by the positive and active act by which the User has ticked the box for the privacy policy hyperlink. The User has the right to withdraw this consent at any time. Withdrawal of consent does not affect the lawfulness of processing based on consent given beforehand.
6. Retention period of personal data
In accordance with Article 13(2) of the Regulation, the Data Controller retains personal data only for as long as is reasonably necessary to achieve the purposes for which it is processed. This period will in all cases not exceed 7 years with regard to the statutory retention period relating to accounting/tax processing.
7. Recipients of data and disclosure to third parties
Personal data may be transferred to employees, staff, subcontractors, processors or suppliers of The Fine Wine Gang, insofar as adequate guarantees are offered for the security of the data and insofar as they cooperate with The Fine Wine Gang in marketing products or providing services.
In the event that data would be disclosed to third parties for direct marketing or prospecting purposes, the User will be informed beforehand so that they can give their prior and express consent to this use of personal data.

9. Rights of Users
The User may exercise their rights at any time by sending a message by e-mail to hello@finewinegang.be, or a letter by post, accompanied by a copy of their identity card, to the following address: A. Vaucampslaan 110, 1654 Huizingen.
a. Right of access
In accordance with Article 15 of the Regulation, The Fine Wine Gang guarantees the User's right of access to their personal data and the relevant information regarding its processing. The copy of the data will be communicated to the User no later than one month after receipt of the request.
b. Right to rectification
In accordance with Article 16 of the Regulation, inaccurate, imprecise or irrelevant data may be corrected or deleted at any time. The User first makes the necessary changes themselves from their user account, unless these cannot be made independently, in which case the request may be addressed to The Fine Wine Gang.
c. Right to erasure
The User has the right to obtain the erasure of their personal data as soon as possible in the cases referred to in Article 17 of the Regulation.
d. Right to restriction of processing
The User has the right to a restriction of the processing of their personal data in the cases referred to in Article 18 of the Regulation.
e. Right to data portability
In accordance with Article 20 of the Regulation, Users have the right to receive their personal data from The Fine Wine Gang in a structured, commonly used and machine-readable format.
f. Right to object and automated decision-making
The User has the right, at any time, to object to the processing of their personal data on grounds relating to their particular situation. Where personal data is processed for prospecting purposes, the User has the right to object at any time.

10. Cookies
The Site uses cookies to distinguish Users of the Site from one another. This makes it possible to provide users with a better browsing experience and to improve the Site and its content.

The holder of parental authority must give express consent for a minor under the age of 16 to disclose personal information or data through the Site. Under no circumstances will personal data be processed by the Data Controller if the user indicates that they are under 16 years of age.
The Fine Wine Gang is not responsible for loss, damage or theft of personal data, in particular as a result of the presence of viruses or following cyberattacks.
12. Security
The Data Controller implements technical and organisational measures to ensure an appropriate level of security for the processing and collection of data. The Data Controller uses standard encryption technologies within the IT sector when transferring or collecting data on the Site.
13. Amendment of the Privacy Policy
The Fine Wine Gang reserves the right to amend this Privacy Policy in order to comply with legal obligations in this regard. The User is therefore requested to regularly consult the Privacy Policy.
14. Applicable law and competent court
This Privacy Policy is governed exclusively by Belgian law. Any dispute will be submitted to the courts of the judicial district of the registered office of The Fine Wine Gang.
